General Service Provisions
1.1 Introduction
It is important that you read these terms and conditions (the “Terms and Conditions’’) carefully, before making a booking, or engaging with Two Sisters (“Two Sisters”, “we”, “us”, “our”) through our experiences or services (the “Services”/ the “Two Sisters Experience”/the “Experience”). References to “you” or “your”, refer to the guest. By engaging with the Services, you confirm that you have read and understood these Terms and Conditions, and that you agree to be bound by them, and you acknowledge that such agreement constitutes a binding contract between you and us. If you do not agree to these Terms and Conditions, you will not be authorised to participate in the Experiences. We reserve the right, at our discretion, to review, revise or update these Terms and Conditions. You agree that you will periodically review these Terms and Conditions for revisions and updates. Your continued use of the Services after any amendments to these Terms and Conditions, constitutes your acceptance of the said amendments.
1.2 Variation of Terms
Two Sisters reserves the right to revise, update, discontinue, or otherwise modify any aspects or features of the Experiences, including, without limitation: availability of the Experiences.
1.3 Privacy and Data Protection
Two Sisters suggests that you review our Privacy Notice, which applies to the information collected, used, and stored by us in relation to the Services, to get a better understanding of our policies and procedures. We may be required by law, to share your personal information with certain third parties, in order to aid any investigation, and comply with our obligations.
1.4 Electronic Communication
Communications between Two Sisters and you, may be sent and received electronically. You agree that all agreements, notices, disclosures, and other communications exchanged between you and us electronically, shall satisfy any legal requirements that such communications be in writing, including, but not limited to, the requirements of the Electronic Transactions Act of Jamaica, and any related current or future legislation or regulations. If, at any point, you do not wish to receive any further electronic communication from us, an opportunity to “opt-out” of receiving further communication will be made available in each communication sent.
1.5 Intellectual Property
1.5.1 | The Two Sisters Experiences, the Services, and promotional material, contain copyright material, trade marks, and other proprietary information, including, without limitation: text, software, logos, photos, graphics (the “Content”). The Content, as well as the organisation, layout, arrangement, and design elements of the relevant material, are our property, and are protected under the Copyright Act and Trade Marks Act of Jamaica and other intellectual property laws which, from time to time, may become applicable.
1.5.2 | You are strictly prohibited from copying, publishing, displaying, transmitting, creating derivative works of, modifying, participating in the transfer or sale of, or otherwise exploiting any of the Content, in whole or in part. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material is permissible without the express written permission of Two Sisters. In the event of any permitted copying, redistribution, or publication of copyright material, there shall be attribution to the author of the Content, and any respective trade mark legend, or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by printing our copyright material.
1.5.3 | Two Sisters offers you access to its Services solely for your personal informational purposes. Unless otherwise agreed with us, in writing, you may not resell, or make any commercial use of the Services, or the Content.
1.6 Liability
1.6.1 | In no event, will Two Sisters, or any person or entity involved in creating, producing, or distributing our Services be liable in contract, in tort (including for its own negligence, unless prohibited under any applicable law) or under any other legal theory (including strict liability) for any damages, including, without limitation: direct, indirect, incidental, special, punitive, consequential, or similar damages, including, without limitation, lost profits or revenues, loss of use, or similar economic loss, arising out of the use of our Services. You hereby acknowledge that the provisions of this section shall apply to all use of and content of our Services.
1.6.2 | In no event, shall Two Sister’s total liability to you for any damages, loss, and causes of action, whether in contract, tort (including its own negligence) or under any other legal theory (including strict liability) exceed the amount paid by you for use of the Services.
1.7 Legal Status
1.7.1 | These Terms and Conditions constitute a binding enforceable contract between Two Sisters and its guests, in respect of the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter.
1.7.2 | These Terms and Conditions shall be construed in accordance with the laws of Jamaica, and it is agreed that any action related to these Terms and Conditions must be brought in the Jamaican Courts.
1.7.3 | If any provision of these Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, the invalidity or unenforceability of such provision shall not affect the other provisions hereof, and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect.
1.7.4 | No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
1.7.5 | The section headings used herein are for convenience only, and shall not be given any legal import.
2. Bookings and Payment
2.1 All bookings must be made in advance through our official booking channels including our website, or by any other method specified by us.
2.2 Full payment is required to confirm a reservation unless otherwise agreed.
2.3 Prices are in the currency quoted on our website, or otherwise specified by us, and include all applicable taxes, Experience activities, and specified meals and drinks.
2.4 Any discounts or promotional offers must be applied at the time of booking, and cannot be added retroactively.
3. Participation & Attendance in the Experiences
3.1 All guests must be 18 years of age or older to participate in our weekly scheduled Two Sisters experiences, as alcohol is served. We are unable to accommodate infants, young children, or unaccompanied minors. By booking any of these Experiences, you confirm that you are 18 years of age or older.
3.2 All guests must be in reasonable physical condition for outdoor activities, including walking on uneven terrain.
3.3 Guests are expected to arrive 15 minutes prior to the scheduled start time of the Two Sisters Experience. Late arrivals may miss portions of the Experience.
3.4 You must follow the instructions of the Experience guide, and adhere to safety protocols at all times.
3.5 Two Sisters reserves the right to refuse participation to any individual deemed unfit, intoxicated, or acting in a disruptive or unsafe manner.
3.6 Private group bookings may be tailored for families and all age groups.
4. Cancellation & Refund Policy
4.1 All bookings are non-refundable.
4.2 Experiences may be rescheduled with at least 72 hours notice, subject to availability.
4.3 In the event of extreme weather or natural disaster, we reserve the right to cancel or reschedule your experience. In such cases, a full refund or alternate date will be offered.
4.4 If you are unable to attend your booked Experience, you are welcome to transfer your reservation to a friend or family member with 48 hours notice.
5. Dietary & Allergen Disclaimer
5.1 All meals are prepared and served in accordance with standard food safety practices, however, our kitchen uses a variety of ingredients including meat, seafood, nuts, seeds, gluten, and dairy. While we take care in preparation, you are advised, and expressly acknowledge that cross-contamination may occur.
5.2 The Two Sisters Experience includes meals and drinks as specified in the itinerary.
5.3 Our weekly group Experiences are served family-style, and are curated around seasonal menus. We are unable to accommodate dietary restrictions, allergies, or substitutions at these events.
5.4 For guests with specific dietary needs or allergies, we recommend booking a private Experience, which can be tailored accordingly.
5.5 We are not liable for allergic reactions, or health issues resulting from food consumption where prior notification was not provided.
6. Health & Safety
6.1 Participation in the Experience is at your own risk.
6.2 By participating, you acknowledge the inherent risks associated with outdoor activities, including but not limited to: slips, trips, falls, insect bites, food sensitivities, and exposure to natural elements.
6.3 Guests should be prepared for outdoor and rural terrain. Please wear appropriate footwear and bring any personal items you may need (hat, sunblock, bug spray, water, etc.).
6.4 By attending a Two Sisters Experience, you acknowledge that you are participating voluntarily, and accept full responsibility for your personal health and safety.
6.5 You are encouraged to secure your own insurance coverage, including travel, health, and accident protection.
7. Weather and Environmental Conditions
7.1 Two Sisters experiences operate rain or shine, except in cases of severe weather or conditions deemed unsafe by us.
7.2 It is reiterated that guests should dress appropriately for the weather and terrain.
7.3 If a Two Sisters experience is shortened or altered due to weather, refunds will be issued only at our discretion.
8. Photography and Media Consent
8.1 By attending a Two Sisters Experience, you acknowledge that photos and videos may be taken of you, for marketing, promotional, or archival purposes.
8.2 By joining the Experience, you grant us the right to use your likeness in marketing materials, unless you specifically object, in writing, prior to the Experience. Therefore, if you prefer not to be included, please let us know upon arrival.
9. Conduct and Respect for Nature
9.1 All participants must treat the environment, wildlife, local communities, and fellow guests with respect.
9.2 Littering, removal of natural or cultural artifacts, or any destructive behaviour is strictly prohibited.
9.3. Any guest who violates these rules may be asked to leave the Experience without a refund.
10. Changes to Itinerary
10.1 While every effort is made to maintain the planned itinerary for the Two Sisters experience, we reserve the right to make changes due to weather, availability, safety, or other circumstances beyond our control.
10.2 Any material changes will be communicated as early as possible.
11. Force Majeure
Two Sisters shall not be responsible for any event outside of our control, including, but not limited to, war, riots, civil unrest, terrorism, fire, storm, flood, plague, epidemic, pandemic, computer or telecommunication network malfunctions or failures, failures of our, or third-party software and hardware, or changes in laws or regulations.
